§ 1 Formation of contract

HCT Hamburg Citytours GmbH submits offers that are non-binding unless otherwise agreed in writing.

Orders can be placed in writing, electronically or verbally.

A contract is formed by HCT's written or electronic confirmation of the order, unless otherwise agreed. Deviations in the confirmation from the order lead to the formation of a contract on the basis of the confirmation if the client agrees within one week.

§ 2 Scope of the service

The scope of services is determined by the order confirmation, irrespective of § 1 para. 3 and § 3.

The service includes the provision of an agreed vehicle with driver and the performance of transportation, without the application of work contract provisions.

Not included in the scope of services:

a. Ensuring the purpose of the trip,

b. Supervision of passengers, especially children, young people and those in need,

c. Supervision of objects left in the passenger compartment,

d. Monitoring of baggage during loading and unloading,

e. Information about relevant regulations such as foreign exchange, passport, visa, customs and health regulations and compliance with them, unless otherwise agreed.

§ 3 Changes to the service

Necessary changes to services after conclusion of the contract are permissible if they were not caused by the bus company and are reasonable for the customer. Changes must be communicated immediately.

Changes by the customer require the written or electronic consent of the bus company.

§ 4 Prices and payment

The price agreed upon conclusion of the contract applies.

Service charges are included in the price, unless otherwise agreed.

Additional costs for changes requested by the customer will be charged additionally.

Costs due to damage or soiling remain reserved.

Invoices are to be paid immediately upon receipt.

§ 5 Cancellation and withdrawal for individual tickets

Cancellation deadlines vary depending on the tour.

Cancellation is non-refundable on the day of validity or in case of no-show.

In the event of premature termination or non-utilization of the vehicle, the exemption from the payment obligation shall lapse, unless the termination results from a circumstance for which the bus company is responsible.

§ 6 Withdrawal and termination by the customer for special trips

Withdrawal: The customer may withdraw from the contract. The bus company is entitled to reasonable compensation, unless the withdrawal is due to circumstances for which the company is responsible. Claims for compensation can be made on a flat-rate basis.

Cancellation: In the event of necessary changes after departure that are unreasonable, the customer may terminate the contract. In the event of termination due to force majeure, the customer shall bear the additional costs for return transportation. In the event of termination by the customer, the company shall be entitled to reasonable compensation.

§ 7 Withdrawal and termination by the bus company

Withdrawal: HCT can withdraw before the start of the trip if unforeseeable circumstances make it impossible to provide the service. The customer may demand reimbursement of necessary expenses.

Cancellation: After the start of the journey, the company may terminate the contract if the provision of the service is significantly impeded, jeopardized or impaired. In the event of termination due to force majeure, the customer shall bear the additional costs for return transportation.

§ 8 Liability

The bus company is liable for the proper execution of the transportation.

No liability in the event of force majeure or unforeseeable events.

Repatriation regulations remain in place.

§ 9 Limitation of liability

Liability for material damage is limited to three times the rental price, except in cases of intent or gross negligence.

§ Section 23 PBefG remains unaffected.

No liability for damage caused exclusively by the customer or his passengers.

§ 10 Luggage and other items

Luggage and agreed items are transported.

The customer shall be liable for any damage caused by items brought along.

§ 11 Conduct of the customer and passengers

The customer is responsible for the behavior of his passengers.

Passengers who disregard instructions may be excluded from transportation.

Complaints should be addressed to the on-board staff or the company.

The customer shall cooperate in the event of performance disruptions.

§ 12 Place of jurisdiction and place of performance

The place of performance is the registered office of HCT Hamburg Citytours GmbH in Hamburg.

The place of jurisdiction is also Hamburg, unless the customer has no general place of jurisdiction in Germany.

German law shall apply.

§ 13 Validity of the provisions

The invalidity of individual provisions shall not affect the validity of the entire contract of HCT Hamburg Citytours GmbH.
